Editor's Note:  Last month the Eugene "Registered Guard" ran an article on the front page on a manufactured home community - Falconwood Manufactured Home Community.  The article has caught the attention of Oregon Legislators who are demanding more protections for residents.  Many of the protections that may be proposed have already been passed into law (HB 3016 - passed in 2015).

Consignments. First, it gave a name to the process; consignment". It is defined as follows: "...an agreement in which a tenant authorizes a landlord[2]to sell a manufactured dwelling or floating home on behalf of the tenant who owns the dwelling or home in a facility that is owned by the landlord and for which the landlord receives compensation."

A 55 plus Community has been in existence for fifteen (15) years. During that time two sets of on-site managers have managed the property. Each management team has allowed a few families to move in believing the community was well within the 20% margin allowed by Federal Fair Housing regulations.

While setting up a disaster plan for manufactured home communities, be sure to include steps that would reduce the risk of damage or injury.  Here are some actions to consider: 

State and local fair housing laws mirror federal laws, but add additional protected classes. In Oregon, for instance, "marital status" and "source of income" are protected classes in addition to the seven federal classes. To these state and federal classes, cities may add additional protections. Eugene and Corvallis, for example are cities that add "age" to the list.

Editor's Note:  As we start the count down to the next full Oregon Legislative Session (2019) one of the biggest issues our industry faces is how to resolve conflict between residents and landlords.
